Phoenix Uber Driver Manages to Run Over 71-Year-Old Woman…Twice https://rideshareattorneyhotline.com/phoenix-uber-driver-manages-to-run-over-71-year-old-womantwice/ Wed, 02 Jan 2019 00:11:51 +0000 https://rideshareattorneyhotline.com/?p=7298 Read more]]> A shuttle bus driver at Sky Harbor Airport in Phoenix, Arizona claims he witnessed an Uber driver run into an elderly passenger of his, only to back his vehicle up and run her over a second time, AZ Family reports.

The incident occurred last week at Terminal 4, and left shuttle bus driver Nate Roberts emotionally devastated. Having just dropped off the 71-year-old victim and her husband at the south side of the terminal and helped them with their luggage, seeing the Uber strike her shortly thereafter was hard to bear.

“I just think of my grandmother,” said Roberts. “If that were to happen, just horrible. When she first got hit, she was up on the hood, and I just went ‘Oh my God’ and everyone turned around to look.”

According to a press release from Dec. 6, Lyft confidentially submitted a draft statement to the U.S. Securities and Exchange Commission announcing plans to list its common stock publicly. That filing beat Uber’s IPO filing by a day.

“New Year’s Eve is a big night for both riders and drivers in San Diego,” said Lyft San Diego Market Manager Hao Meng. “We encourage Lyft riders to ride smart and plan ahead for a responsible ride home when ringing in 2019 with friends and family. After it receives approval from the state of Pennsylvania, Uber plans to begin driving “a handful” of cars on a mile loop between two company offices in Pittsburgh, where Uber first debuted its autonomous vehicles in 2016, company spokeswoman Sarah Abboud said. That would mark Uber’s first self-driving car tests on public streets since it halted its operations nearly nine months ago in the wake of a crash in Arizona that killed a pedestrian.

Uber’s Arbitration Policy Comes Back to Bite It in the Ass https://rideshareattorneyhotline.com/ubers-arbitration-policy-comes-back-to-bite-it-in-the-ass/ Thu, 06 Dec 2018 02:55:32 +0000 https://rideshareattorneyhotline.com/?p=7267 Read more]]> Over 12,000 Uber drivers found a way to weaponize the ridesharing platform’s restrictive contract in what’s possibly the funniest labor strategy of the year.

But first: a bit of background. One of the more onerous aspects of the gig economy is its propensity to include arbitration agreements in the terms of service—you know, the very long document no one really reads—governing the rights of its workers. These agreements prohibit workers from suing gig platforms in open court, generally giving the company greater leverage and saving it from public embarrassment. Sometimes arbitration is binding; in Uber’s case, driver’s can opt out—but only within 30 days of signing, and very few seem to realize they have the option.

“Bird or Lime Might Help Sweeten the Deal”: Inside Uber’s I.P.O. Endgame https://rideshareattorneyhotline.com/bird-or-lime-might-help-sweeten-the-deal-inside-ubers-i-p-o-endgame/ Thu, 06 Dec 2018 02:52:47 +0000 https://rideshareattorneyhotline.com/?p=7264 Read more]]> Once the uncontested titans of ride-sharing, Lyft and Uber were quick to act when they noticed electric bike and scooter-sharing start-ups eating away at their dominance. The former snapped up its own bike-share company in Motivate, which operates Citi Bike, and Uber bought electric-bike company Jump, and invested in scooter start-up Lime. But their appetites appear far from sated, particularly as Uber looks to diversify its war chest of transportation options ahead of a 2019 I.P.O. Hence, stories in the Information and the Financial Times this past week, which both reported that Uber is considering deals to buy either Lime or Bird outright. “Uber saw scooters chipping away at the role ride-sharing played in last-mile transit, and they thought, ‘We should get into that,‘” one Silicon Valley investor told me, by way of explanation. “They have a stake in Lime, but why not just buy one of these companies outright?”

The talks, the Financial Times reported, are still in early stages, and may yet fall apart, “especially over the price of the young companies with business models that are unproven.” It wouldn’t be cheap for Uber to buy either company, though its existing share in Lime would likely alleviate some of that cost. Since launching, and in spite of some backlash, both Bird and Lime have raised hundreds of millions of dollars at eye-popping valuations, and launched services in dozens of cities not only in the United States, but around the world. Beyond that, they run expensive businesses that require the acquisition and maintenance of vehicles up front.

The Electric Scooter Craze: What Can Employers Do to Protect Themselves from Potential Liability? https://rideshareattorneyhotline.com/the-electric-scooter-craze-what-can-employers-do-to-protect-themselves-from-potential-liability/ Tue, 04 Dec 2018 20:24:20 +0000 https://rideshareattorneyhotline.com/?p=7261 Read more]]> If you haven’t ridden one yet, it’s likely you’ve had one fly by you on the sidewalk. Electric scooters – or e-scooters – have quickly descended upon most major cities in America. These app-based scooters let a user ride across the city at up to 15 m.p.h. and then discard the scooter wherever the rider happens to disembark. While relatively new, injuries from riding these scooters are already fairly common, and the scooters also have even been involved in some fatal accidents already. With the use of e-scooters on the rise, an employer should be prepared for the potential legal problems they create.

The increasing popularity of these scooters indicates that some employees will, sooner or later, jump on an e-scooter during work hours. Thus, an employer should lose no time in doing the following:
